All models, actors, actresses and other persons that appear in any visual depiction, whether of actual or simulated sexual behavior or otherwise, that is contained in the website were over the age of eighteen years at the time of the creation of such.

Exemption: Content Produced by Third Parties

The operator of hdporno.tv is not the primary "producer" of any images or video recordings of explicit sexual or simulated sexual activity that may be shown there. With respect to such, the operators confine their activities to the transmission, storage, retrieval, hosting and/or formatting of the content contributed by third-party users. All parts of hdporno.tv on which user-supplied content appears are under those users' control. Consequently, the operators and owners of the website are absolved from compliance with Section 2257 records keeping and labeling obligations as laid out in 28 C.F.R. §75.1(c)(4). Any content that is deemed illegal, obscene, harmful, harassing, defamatory or in any respect incompatible with the terms of use and policies of the website, may be removed as decided solely by the operator or owner, in keeping with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

Exemption: Content Produced by Website Operator

Any visual depictions that may appear on the website, for which the operator of the website may be regarded as the “producer,” are excluded from compliance with the provisions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not show any sexually explicit behavior as outlined in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not show depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not show simulated sexually explicit conduct; or (4) the images or videos were produced before July 3, 1995.
